Terms & Conditions

By using montiprimo.com (the “Site”) and the services offered by Monti Primo Ristorante (“Monti Primo,” “we,” “our,” or “us”), you agree to these Terms & Conditions. If you do not agree, please do not use the Site or our services.
1. Use of the Site
You may use the Site for personal, non-commercial purposes. You agree not to: (a) interfere with or disrupt the Site or servers; (b) attempt to gain unauthorized access; (c) use any automated means (bots, scrapers) to access or copy material; (d) reverse engineer or attempt to extract source code; or (e) use the Site in any way that violates applicable laws.
2. Orders, Pickup & Delivery
- Pickup and delivery orders are accepted during our normal operating hours (11 AM – 10 PM daily) and subject to kitchen capacity.
- Orders placed via third-party delivery platforms (Uber Eats, DoorDash, Grubhub, Slice, Postmates, ezCater) are also governed by those platforms’ terms of service.
- Prices and menu items are subject to change without notice. Final pricing is confirmed at checkout.
- Allergen and dietary information is provided in good faith but our kitchen handles common allergens (gluten, dairy, eggs, nuts, shellfish). We cannot guarantee an allergen-free environment.
3. Catering & Private Events
- Quotes are estimates based on the information provided. Final pricing is confirmed in your written event proposal.
- Deposits may be required to hold a date. Deposit policy is communicated at the time of booking.
- Cancellations made more than 7 days before the event receive a full refund of any deposit. Cancellations within 7 days may forfeit the deposit.
- Headcount changes must be communicated at least 72 hours in advance to adjust the order.
- Service charges, tax, and gratuity are added per the event proposal unless otherwise specified.
4. Gift Cards
- Gift cards purchased through montiprimo.com are delivered digitally by email with a redemption code.
- Gift cards never expire and never lose value.
- Bonus cards issued through promotional offers expire one year from the issue date, cannot be used on the same visit as the primary card, and exclude alcohol, tax, gratuity, and private-event packages.
- Gift cards are non-refundable and cannot be exchanged for cash, except where required by law.
- Lost or stolen gift cards cannot be replaced. Treat them like cash.
5. VIP Club
- The Monti Primo VIP Club (the “Famiglia”) is free to join. We may modify program benefits, tiers, or terms with advance notice.
- Points and rewards accrue on dine-in visits with a minimum check of $25.
- Rewards are non-transferable and have no cash value.
- One reward redemption per visit. Cannot be combined with other promotions.
- Blackout dates apply on Valentine’s Day, Mother’s Day, Father’s Day, and New Year’s Eve for milestone discounts. Birthday and anniversary perks are honored on all dates.
- Visit tier (Silver / Gold / Platinum) recalculates on a rolling 12-month basis.
- We reserve the right to suspend or terminate any membership for abuse, fraud, or violation of these terms.
6. Reservations
Reservations made by phone are confirmed verbally. Please give us notice for cancellations so we can offer the table to other guests. Large parties (10+) may require a credit card to hold the reservation.
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, photographs, and the Monti Primo name — is the property of Monti Primo Ristorante or its licensors and is protected by trademark and copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
Third-party trademarks and brand names referenced (e.g., Uber Eats, DoorDash, Grubhub, Slice, Postmates, ezCater) are the property of their respective owners.
8. User-Submitted Content
Any information you submit through inquiry forms, the VIP signup, or other channels is governed by our Privacy Policy. By submitting feedback, reviews, or suggestions, you grant us a non-exclusive, royalty-free license to use that content in connection with our business.
9. Third-Party Links & Services
The Site links to third-party services (delivery platforms, Google Maps, payment processors). We are not responsible for the content, practices, or policies of those services. Your use of them is governed by their own terms.
10. Disclaimer of Warranties
The Site and our services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, Monti Primo and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or services, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Monti Primo Ristorante from any claim, loss, liability, or expense (including reasonable attorney’s fees) arising out of your violation of these Terms or misuse of the Site.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Marion County, Florida, and you consent to the jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
